Oracle Claims $1b In Damages from Arch-Rival SAP
Oracle Suffers Because of SAP and the IP Hacking Theft of Its TomorrowNow PeopleSoft/ JD Edwards Customer Support Subsidiary
Jul. 6, 2008 08:45 AM
To no one’s particular surprise, Oracle has claimed that it
suffered hundreds of millions, if not “at least” a billion dollars worth of
damages because of SAP and the IP hacking theft of its TomorrowNow PeopleSoft/JD
Edwards customer support subsidiary.
In a discovery filing relative to its 15-month-old suit
against them Oracle said it still doesn’t know the “damages with precision”
because the defendants didn’t give it “critical information relevant to liability
and resulting damages” to which SAP rejoined that “Oracle speculated wildly
about the amount of its damages” and “still refuses to identify with any
precision the nature or amount of its alleged harm or even to provide the
theory on which its damages claim is based.”
SAP of course has already admitted that TomorrowNow poached
Oracle IP it shouldn’t have but has produced millions of pages that are
supposed to prove SAP itself wasn’t involved.
The parties will see each other in court in February.
Oracle claims TomorrowNow illegally downloaded masses of
Oracle support material and passed the IP to SAP.
